Gays bias fears over sex offenders register - Sex Offenders

People convicted of having anal sex with males aged 16 to 20 before the act became legal will still be registered as sex offenders, according to a proposal by a legal body.

However, human and gay rights advocates have criticized the proposal, saying the inclusion of the outdated crimes on a database would be unfair to homosexuals seeking jobs.

A Law Reform Commission subcommittee wants 41 sexual offenses covered by the proposal.

They include homosexual buggery with or by a man under 21 and that committed otherwise than in private which was ruled unconstitutional in 2005.

A member of the review of sexual offenses subcommittee and Hong Kong University law professor Eric Cheung Tat-ming said yesterday it is no longer illegal for homosexuals to have anal sex as long as they are 16 or older. He said the proposal allowing employers to check whether those seeking jobs involving children or the mentally handicapped are sex offenders is an interim measure.
